Priority Trademark Processing Now Available in Brazil

On August 7th, the Brazilian Patent and Trademark Office (BPTO) will launch a new service: Priority Trademark Processing. This initiative is part of the INPI 2025 Action Plan, aiming to accelerate trademark procedures, support innovation, and drive economic growth in Brazil.

Faster Trademark Examination Aligned with Strategic Goals

This new service will allow certain trademark applications and petitions to be examined more quickly, following legal criteria and strategic public policies. The goal is to streamline the process for individuals and entities whose applications meet specific eligibility requirements.

Who Will Be Eligible?

Requests for priority processing may be submitted by the applicant or their legal representative. The process involves submitting a dedicated form, supporting documents, and paying any applicable fees. For jointly owned applications, all applicants must qualify.

Two Main Categories of Eligibility

1. Legally Defined Priorities

  • Individuals aged 60 or older

  • People with serious illnesses or disabilities

  • Companies operating under the Inova Simples framework

2. Strategic and Policy-Based Priorities

  • Applicants who filed oppositions based on prior rights

  • Applicants who need registration to access public funding

  • Applicants involved in ongoing legal proceedings

  • Trademark applications related to patents with priority processing

  • Scientific, Technological, and Innovation Institutions (ICTs)

  • Mentees under INPI’s Technical Cooperation Agreements (ACTs)

  • Cases of national emergency or public interest

This new pathway provides an important tool for stakeholders across Brazil’s innovation ecosystem to obtain faster IP protection.
