Brazil: Simplification and Modernization of Trademark Registration Processes

The Brazilian National Institute of Industrial Property (INPI) has recently implemented significant measures to simplify and modernize trademark registration processes. These reforms aim to reduce costs and facilitate access to the system for both domestic and international companies and entrepreneurs. 

Elimination of Sworn Translations for Foreign Documents 

One of the main changes is the elimination of the requirement for sworn translations for certain foreign-language documents. Now, many documents can be submitted with simple translations, without the need for legalization or apostille, significantly reducing costs and expediting procedures for foreign companies wishing to operate in Brazil. 

Registration of Advertising Slogans as Trademarks 

Another important innovation is the authorization to register advertising slogans as trademarks. Since November 27, 2024, INPI allows the registration of slogans, provided they have sufficient distinctiveness and are not generic or merely promotional expressions. 

These reforms reflect INPI’s commitment to modernizing the industrial property system in Brazil, promoting a more accessible and efficient environment for trademark protection.
