New boost for patent processing in the Pacific Alliance

The Pacific Alliance, comprised of Chile, Colombia, Mexico, and Peru, has been a pioneer in promoting regional integration, and intellectual property (IP) is no exception. A fundamental pillar of its efforts has been the Accelerated Patent Examination Mechanism, a strategic initiative designed to streamline the patenting process among member countries. By 2025, this mechanism will be significantly strengthened, promising a more efficient and harmonized IP landscape. 

Understanding the accelerated examination mechanism 

This mechanism works similarly to a “Patent Fast Track” (PPH). It allows patent applications that have already been submitted and passed examination at one of the Alliance’s member IP offices to request expedited review at another. The central idea is simple but compelling: to eliminate redundant examination procedures, significantly reduce processing times, and facilitate the cross-border protection of innovative creations in the region. 

Strengthening” in 2025: Key Expectations 

The concept of “strengthening” in 2025 encompasses several crucial dimensions aimed at maximizing the mechanism’s effectiveness and reach: 

  1. Increased utilization: A key objective for this year is to achieve greater adoption of this accelerated route. Alliance IP offices continue to actively promote its benefits and work to simplify the process and make it even more accessible for applicants. This includes outreach programs and user-friendly guidelines to encourage more innovators to take advantage of this efficient route. 
  2. Operational Efficiency: Member offices are focusing on improving internal coordination and efficiency in processing these accelerated applications. This could involve greater standardization of application forms, streamlining communication channels between national IP offices, and ongoing training for examiners to ensure consistent and expeditious review. The goal is to create a smooth and predictable experience for applicants. 
  3. Performance Evaluation and Refinement: Throughout 2025, Alliance authorities and national IP offices are expected to conduct periodic evaluations of the mechanism’s impact. These evaluations will examine its effectiveness in reducing examination times and its overall contribution to fostering regional innovation. The information obtained from these evaluations will be critical for making any necessary adjustments or improvements to the program, thus ensuring its agility and responsiveness to the needs of innovators. 
  4. Potential for Expansion: While no new specific announcements have been confirmed for 2025, ongoing strengthening efforts naturally include discussions on expanding the scope of the mechanism. This could involve exploring its applicability to more types of inventions or considering initiatives to further integrate intellectual property within the Alliance. Such discussions reflect a progressive approach to intellectual property as a key driver of economic development. 

Thus, 2025 marks a period of consolidation and refinement for the Pacific Alliance’s accelerated patent examination mechanism. The focus remains firmly on improving efficiency, reducing barriers, and creating a more robust framework for intellectual property protection that directly supports the region’s innovative ecosystem.
