Regarding Brazil, we continue waiting for the Brazilian Supreme Court to issue its final ruling upholding or not the current suspension of Article 40 of the Industrial Property Law (Law 9.279 / 1996) setting forth a minimum period of patent validity of 10 years. That suspension was declared on a preliminary decision issued on April 7th, 2021, and currently applies to several pharmaceutical patents as we described in this short post.
Given the high relevance and interest of this case we are going to cover any news arising therein together with the Mexican Supreme Court decision issued in October 2020, which extended the period of validity of Mexican patent No. 238942, owned by Bayer and related to a pharmaceutical product.
So in 40 minutes, we will review the situation in Brazil as well as the legal strategy implemented in Mexico by Bayer to gain almost 3 years of patent protection.
